This web-site is intended to be a friendly, enjoyable and useful experience, but as with anything concerning any kind of transactions there are risks involved and we strongly advise you to understand all of these terms before joining. If you spot a listing that you feel is violating the general terms and conditions of this web-site as stated below please let us know by contacting us.

Rights To Suspend or Terminate

You agree that this web-site, in its own discretion, may terminate any auction or use of the service immediately and without notice if

(a) We believe that you are not abiding by the general rules of this web-site

(b) You have repeatedly broken a certain term

(c) You have listed a suspicious item

(d) We believe you to be a non paying bidder.

(e) We suspect, for any reason, that items you have, or had, for sale may not be legitimate or legally obtained. An example would be the selling of high price items at well below market value.

(f) There are inconsistencies in your membership details

In most cases when we suspect foul play we will suspend your account/listing whilst we investigate further. If our investigation is conclusive then your account with us will be terminated.

Your Conduct

You are solely responsible for the contents of your actions through this web-site. You must ensure that your participation in the selling or buying of items does not violate any applicable laws or regulations. By this we mean that you must check that you entitled to sell or buy the relevant item and that you are not prohibited from doing so by any law or regulation.

You must not transmit through the service any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. You must also not transmit any material that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law or regulation.

Prohibited items are those disallowed to be sold by Australian Law and specifically Victorian Law. This also includes all and any counterfeit items. BidMate has zero tolerance for items in breach of copyright laws. Care should be taken to avoid items that cannot be legally shipped such as those prohibited by Australia Post, which includes the list here. If an item is legal to sell, such as Perfume, but illegal to ship by Australia Post then Australia Post must not be indicated as a shipping option.

You agree you cannot use Auctions, the message system or other BidMate resources to encourage sales that will be transacted outside the BidMate system. Failing to adhere to this rule can result in suspension or sanction.

Membership

(a) Membership to this web-site is only available to those you can form a legally binding contract. This web-site does not permit minors (under 18) to register. If any member fails to sign-up with their correct age the account will be terminated immediately.

(b) On request, we will, at our discretion, refund unused amounts deposited by members into Sellers accounts within 18 months of the deposit. Free additions or credits to Sellers accounts are not refundable. Where there is a mixture of Members funds and free additions in an account then the Member deposited funds are deemed used first.

(c) Credits give by BidMate from time to time including joining credit cannot be used for the purchase of items. Funds in Sellers accounts can only be used to pay Selling Fees which includes listing fees and final value fees.

(d) Any free additions to members account, including joining credits or other amounts applied from time to time, must be used within six months. Once 6 months have passed, any free credits, applied by admin, can be removed and voided entirely, at any time, at the discretion of BidMate Admin.

(e) Members committing major breaches of site rules or those breaking Australian laws will be immediately suspended and where requested Authorities will be assisted in every possible way. We will not consider refunding fees in these cases until extensive ID verification has been satisfactorily completed or we are directed by Authorities to make a refund.

(f) Accounts cannot be cancelled by request until a period of 120 days has passed since the last transaction involving the member has passed. Sellers must end Auctions and wait 120 before we can close the account. Accounts with disputes cannot be terminated until 120 days after the dispute is resolved. These measures are principally to assist Authorities minimising online fraud.

(g) BidMate or its agents can and will conduct random or tageted security checks at any time. Users being checked may be asked to provide additional ID information. Where, BidMate believes, Sellers may be offering suspicious items, BidMate may ask Sellers to supply proof of purchases in the form of invoices or other types of proof before allowing said items to be sold.

General Terms

This site acts as the window for sellers to conduct auctions and for bidders to bid on sellers' auctions.

We are not involved in the actual transaction between buyers and sellers.

As a result, we have no control over the quality, safety or legality of the items listed the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to buy items.

We cannot and do not control whether or not sellers will complete the sale of items they offer or buyers will complete the purchases of items they have bid on.

In addition, note that there are risks of dealing with foreign nationals, underage persons or people acting under false pretence.

This Web-site shall not be responsible for any items sold by Auction, for any damage to items during transit or during the inspection period, nor for misrepresentations and/or breaches of contract by either buyer and/or seller.

This web-site shall not be responsible for the cost of procurement of substitute goods or any losses resulting form any goods purchased or obtained.

This web-site assumes no liability for the content of the listings.

However if you fall victim of a fraudulent transaction we will assist you as much as we can.

Laws

BidMate is a wholly owned subsidiary of Gully Corp Pty Ltd in Trust for The Gully Settlement ABN 64337196454 which are Victorian entities.

These Terms of Service shall be governed by and constructed in accordance with the laws of Australia and Victoria and any disputes will be decided only by the Courts of Australia and Victoria.
